CFTC Chair Outlines Registration Path for Crypto Exchanges

CFTC Chairman Michael Selig said on Oct. 26 that the agency is advancing a federal registration pathway for crypto exchanges, with requirements depending on the products they offer.

For traders, the initiative could bring participating platforms under rules designed for certain crypto transactions. The framework remains under consideration, and the agency has not finalized the contemplated registration category.

CFTC Considers Crypto Asset Market Category

The Commodity Futures Trading Commission (CFTC) opened a consultation on Oct. 5 covering certain retail crypto transactions offered on a leveraged, margined or financed basis. It is seeking feedback to inform potential future rulemaking.

The agency is considering a registration category called a crypto asset market for platforms offering covered transactions. It is also asking how a federal framework could address abusive practices and clarify requirements for market participants.

Leveraged trading allows customers to take positions using borrowed funds or other financing. It can increase both potential gains and losses, making the rules governing platforms and transactions relevant to retail traders.

The consultation is an advance notice of proposed rulemaking and does not itself establish a final registration regime. Comments are due Dec. 14, 2026.

Requirements Depend on Products Offered

In an Oct. 5 speech, Selig stated only Congress could require all crypto exchanges to register with the CFTC. He distinguished that broader authority from the agency’s existing jurisdiction over certain retail transactions involving leverage, margin, or financing. Selig also said:

“Only Congress has the authority to mandate that all crypto asset exchanges register with the Commission”

He stated that the ordinary spot-only crypto exchanges generally operate under state money-transmission laws and remain subject to the CFTC’s antifraud and antimanipulation authority. Exchanges offering covered leveraged, margined or financed retail transactions must register with the agency, he said.

That distinction matters for exchanges deciding which products to offer. A federal pathway described as voluntary for the industry as a whole does not remove existing requirements for covered transactions.

Proposed Category Would Fit Existing Framework

The contemplated crypto asset market category would be a subcategory of a designated contract market, the CFTC’s existing registration framework for regulated exchanges. It would be designed specifically for the covered crypto transactions.

Selig also distinguished platforms offering derivatives, such as perpetual contracts, from ordinary spot exchanges and those offering covered leveraged retail crypto transactions. He said derivatives exchanges must register with the CFTC under the applicable framework.
